Terms of Service

Welcome to Claimify. These Terms of Service ("Terms") govern your access to and use of the Claimify service at https://claimifyai.com, including the web dashboard, AI email drafting, invoice import, and payment tracking features (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Claimify, you confirm that you are at least 18 years old, that you have the legal authority to enter into this agreement on behalf of your organization, and that you accept these Terms in full. If you do not agree to these Terms, do not use the Service.

2. The Service

Claimify is an autonomous accounts receivable collections agent. It reads overdue invoice data you provide (via CSV upload or connected accounting platform), drafts personalized follow-up emails using AI, sends those emails from your connected domain, and tracks replies and payment status in a web dashboard.

Claimify does not guarantee that any invoice will be paid, that any customer will respond, or that any email will be delivered or opened. Email deliverability depends on recipient servers, domain reputation, and content — all of which are outside Claimify's control.

3. Account and Eligibility

You must provide accurate, complete information when creating your account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. You may not share your account with more users than your plan allows.

Claimify reserves the right to suspend or terminate accounts that violate these Terms, that engage in fraudulent activity, or that use the Service in ways that harm third parties or Claimify's infrastructure.

4. Acceptable Use

You agree to use Claimify only for lawful, B2B accounts receivable purposes. You may not use Claimify to:

You represent that you have the legal right to send emails on behalf of your connected domain and that your use of Claimify complies with all applicable email regulations.

5. Fees and Billing

Paid plans are billed monthly at the rates published at https://claimifyai.com/pricing. All fees are non-refundable except as required by law. You authorize Claimify to charge your payment method on file on each billing cycle.

All plan upgrades take effect immediately. Downgrades take effect at the end of the current billing period. If we cannot charge your payment method, we may suspend your account after 14 days of failed attempts.

6. Data Ownership and Backup

Your data is yours. You retain all ownership rights to the invoice data, customer contacts, and email content you upload to Claimify. We do not use your data for any purpose beyond operating your AR workflow.

You may export your data from Claimify at any time via the dashboard export function. We recommend maintaining your own backups of critical AR records.

7. Third-Party Services

Claimify integrates with third-party services including QuickBooks, Xero, FreshBooks, Wave, Sage, NetSuite (via OAuth), Postmark (email delivery), OpenAI (AI drafting), and Stripe (payments). Your use of these third-party services is subject to their respective terms and privacy policies. Claimify is not responsible for the actions or omissions of third-party providers.

8. Intellectual Property

The Claimify service, including its design, code, brand, and documentation, is owned by Claimify, Inc. and protected by intellectual property law. You may not copy, reverse-engineer, or create derivative works of the Claimify service without written permission.

You retain ownership of your invoice data and customer information. You grant Claimify a limited license to process this data solely for the purpose of operating the Service on your behalf.

9. Service Availability

Claimify aims for 99.9% uptime but does not guarantee continuous availability. Scheduled maintenance windows will be communicated in advance when possible. We are not liable for losses arising from service interruptions, data loss, or delayed or failed email delivery.

Enterprise customers are entitled to SLA guarantees as specified in their Enterprise agreement.

10. Limitation of Liability

To the maximum extent permitted by law, Claimify, Inc. and its officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages — including loss of revenue, profits, data, or business opportunities — arising from your use of the Service, regardless of the theory of liability.

Claimify's total liability for any claim arising from the Service shall not exceed the total fees paid by you to Claimify in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Claimify, Inc. and its officers from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party rights.

12. Termination

You may cancel your account at any time from your account settings. Claimify may terminate or suspend your account immediately if you breach these Terms, if we are required to do so by law, or if we reasonably believe your use poses a security risk. Upon termination, your data is retained for 90 days before deletion.

13. Modifications to Terms

We may update these Terms from time to time. If the change is material, we will notify you via email and/or a dashboard notice at least 30 days before the new Terms take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the new terms.

14. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in San Francisco County, California.
